Joe Biden prosecutor Jack Smith had one more card to play.
Smith resigned from the Justice Department in disgrace after his two witch hunts against Donald Trump imploded.
Trump winning re-election scuttled any hopes Smith had of staging show trials for Trump in Washington and Florida in the January 6 and Mar-a-Lago documents hoaxes.
But Smith thought he could get one last shot in at Trump by handing over his report on these persecutions to Attorney General Merrick Garland so Garland could make them public in an effort to throw a damper on Trump’s inauguration.
Garland released Smith’s report on the January 6 hoax, which dominated the news cycle for about six minutes before the American people yawned and moved on.
Trump and Kamala Harris litigated January 6 during the campaign and Americans decided it wasn’t that big a deal and re-elected Trump, despite Kamala Harris claiming the events of that day supposedly disqualified Trump from holding office.
Judge Aileen Cannon dismissed the criminal charges Smith brought against Trump in the Mar-a-Lago document hoax.
And Judge Cannon rejected Smith and the Justice Department’s bid to release the report on this sham persecution in the strongest terms necessary.
Judge Cannon slammed Smith for trying to destroy Constitutional and criminal justice system norms to smear Trump one last time.
“Never before has the Department of Justice, prior to the conclusion of criminal proceedings against a defendant — and absent a litigation-specific reason as appropriate in the case itself— sought to disclose outside the Department a report prepared by a Special Counsel containing substantive and voluminous case information. Until now,” Cannon stated.
Smith’s charges against Trump’s co-defendants Walt Nauta and Carlos De Oliveire are still active.
And Judge Cannon agreed that releasing this report would impair their right to a fair trial, as making the evidence public would taint the jury pool and because they are still appealing for the charges to get dismissed.
“Meanwhile, on the other side of the balance, there are two individuals in this action, each with constitutional rights to a fair trial, who remain subject to a live criminal appeal of this Court’s Order Dismissing the Superseding Indictment,” Cannon added.
Cannon also castigated Smith for pulling a stunt never before tried in history to release a report to Congress before the pending criminal proceedings concluded.
“There is no ‘historical practice’ of providing Special Counsel reports to Congress, even on a limited basis, pending conclusion of criminal proceedings,” Cannon continued.
“In fact, there is not one instance of this happening until now,” Cannon remarked.
Jack Smith’s persecutions of Donald Trump should go down in history as a legal disgrace, as Smith was willing to bend the law and precedent at every turn as part of a mad crusade to jail Trump.
Judge Cannon has one more opportunity to etch that fact into the official record.
