Tuesday was day two of Amy Coney Barrett’s Supreme Court confirmation hearings.

Democrats tried to score political points at Barrett’s expense and destroy her nomination.

But Amy Coney Barrett stunned Democrats with one answer about how she will act on the Supreme Court.

Democrats are trying to paint Amy Coney Barrett as a radical ideologue who will act as a politician on the court looking to impose her views on the Supreme Court.

Liberals only want Democrat-appointed justices to act as politicians and impose policy preferences that run afoul of the Constitution.

Senate Judiciary Committee Chairman Lindsey Graham set Barrett up to knock down this premise by asking her if the court would take up a case that challenged the 2008 Heller opinion that established gun ownership of a fundamental right.

Barrett said that if a state tried to overturn Heller and ban or confiscate guns, the Supreme Court would have to wait for the case to make its way through the system before ruling.

“If someone challenged Heller below, because a state or local government passed a law contradicting Heller, the Supreme Court would have to take that case, once it was appealed, all the way up,” Barrett explained. “So, the court would have to decide, yes, we want to overrule and we have enough votes to grant cert and then do so.”

Barrett explained that it wasn’t up to Justices to act on their personal beliefs, but that they must only rule on the cases before them as they arise.

“Judges can’t just wake up one day and say, ‘I have an agenda, I like guns, I hate guns, I like abortion, I hate abortion,’ and walk in like a royal queen and impose their will on the world,” Barrett stated.

“You have to wait for cases and controversies, which is the language of the Constitution, to wind their way through the process,” Barrett concluded.

Through two days of hearings, Barrett came across as a likeable, supremely competent, and highly qualified Supreme Court nominee.
Democrats failed to lay a glove on her.
