Letitia James pulled one dirty trick to seize Donald Trump’s money

Democrats are running a scorched earth lawfare campaign to destroy Donald Trump.

The first leg resulted in victory.

And Letitia James pulled one dirty trick to seize Donald Trump’s money.

Democrat Judge Arthur Engoron awarded Democrat New York Attorney General Letitia James damages of $364 million against the Trump Organization in her political hit job civil fraud suit.

Former President Donald Trump will appeal this decision as it violates the takings clause of the 5th Amendment and 8th Amendment protections against excessive fines.

But there is a poison pill in Judge Engoron’s ruling.

New York’s nine percent interest rate means the real penalty is $460 million.

And to appeal the case Donald Trump will have to pay nearly half-a-billion dollars up front either in case or get a bank to post a bond.

George Washington Law Professor Jonathan Turley wrote that securing a bond could be difficult as Engoron also barred Trump from doing business with any financial institution based in New York.

“Under New York law, Trump cannot appeal this ruling without depositing the full amount, including interest, in a court account. Even for Trump, $455 million is hard to come by. Likewise, a bond would require a company to guarantee payment for a defendant who has been barred from doing business in New York and is facing the need to liquidate much of his portfolio,” Turley wrote.

“Nothing succeeds like excess for judges like Engoron. By imposing this astronomical figure, he can make it difficult or impossible for a defendant to appeal, absent declaring bankruptcy or selling off assets at distress prices,” Turley added.

“The excessive fine and its basis raise serious statutory and constitutional questions. Many of us believe it should be substantially reduced or tossed out entirely,” Turley concluded.

Never before in New York history has the civil fraud statute been used in a case where there is no victim.

Bank executives testified that they were eager to do business with Trump and that he paid all his loans on time.

New York Governor Kathy Hochul confirmed this a politically motivated guided missile when she publicly reassured New York business owners that the fraud statute would never be used in such a manner again.

The goal of his lawsuit wasn’t just to steal all of Trump’s money.

It was to weaponize the legal system – using partisan Democrat judges and prosecutors – to brand him a fraud so President Joe Biden can attack him in the General Election.
