Joe Biden imposed a federal vaccine mandate on all healthcare workers who work for facilities that receive Medicare or Medicaid funds.
U.S. District Court for the Eastern District of Missouri Judge Matthew Schelp temporarily stayed the mandate while legal challenges played out, ruling that the ten states that filed the lawsuit were likely to win on the merits.
Judge Schlep slammed the administration’s vaccine mandate for violating the U.S. Constitution.
“C.M.S. seeks to overtake an area of traditional state authority by imposing an unprecedented demand to federally dictate the private medical decisions of millions of Americans,” Judge Schelp ruled. “Such action challenges traditional notions of federalism.”
Judge Schelp also ruled the plaintiffs were likely to succeed based on the fact that Congress did not legislate the Center for Medicare and Medicaid Services the authority to issue this vaccine mandate.
This is the second setback for the Biden administration on vaccine mandates.
The Fifth Circuit Court of Appeals extended a stay blocking the implementation of Joe Biden’s federal vaccine mandate for companies that employ more than 100 workers.
When Biden issued these tyrannical mandates, critics slammed them as blatantly unconstitutional.
