Marco Rubio Just Answered a Federal Judge Who Tried to Gut His Vetting Rules

Judge Jeannette Vargas branded Trump's welfare vetting policy Orwellian last week.

Days later, Secretary of State Marco Rubio froze every immigrant visa interview on the planet.

What Rubio's new vetting training is designed to catch remains the untold part of this story.

Judge Vargas Calls Trump's Vetting System Orwellian and Strikes It Down

A Biden-appointed federal judge in Manhattan just told the State Department it has no right to protect your tax dollars from foreign nationals who can't support themselves.

Judge Jeannette Vargas vacated the Trump administration's policy pausing immigrant visas for 75 countries flagged as high-risk for public benefits dependency.

The policy, in effect since January, targeted nations where government data showed more than 30 percent of immigrant households were collecting welfare.

Vargas didn't just disagree with the policy, she mocked it.

"The Government engages in what is best described as an exercise in Orwellian logic," she wrote.

She claimed Secretary Rubio exceeded his statutory authority and stripped consular officers of their role in deciding who gets in.

The plaintiffs who brought the case included the Catholic Legal Immigration Network and African Communities Together, groups that exist to keep the door open no matter who walks through it.

Vargas ordered the government to revisit every visa denial tied to the freeze, potentially reopening the door to tens of thousands of applicants from countries like Somalia, Afghanistan, Haiti, and Sudan.

Rubio Answers With a Worldwide Freeze on Visa Interviews

Rubio didn't fold.

He went bigger.

Within days of the ruling, the State Department quietly ordered every U.S. embassy and consulate on Earth to pause immigrant visa interviews.

The official reason is training, consular officers worldwide are being drilled on how to evaluate applicants "comprehensively and consistently" for the likelihood they'll end up on the taxpayer dole.

Training sessions were expected to wrap up at most posts this week.

Applicants who had interviews scheduled got cancellation notices with no rescheduling date attached.

That means no new dates, no clear answers, and every visa officer on the planet getting re-briefed on exactly what public charge risk looks like.

This is Rubio effectively rebuilding the vetting standard nationality by nationality, one consular post at a time, instead of relying on the country list Vargas just gutted.

The freeze covers immigrant visas from every country, not just the 75 nations named in the original policy.

The State Department has also revoked more than 100,000 visas under a separate continuous vetting program running in the background of all this.

This Is What Happens When Judges Try to Run the State Department

Here's what fires me up about this one: a judge who has never had to explain a welfare bill to a taxpayer just told the Secretary of State he can't ask who's going to pay their own way.

This isn't new territory for Trump, his first-term travel ban faced the exact same legal ambush in 2017, got gutted by lower courts, and still ended up upheld by the Supreme Court once the hysteria wore off.

Mark Krikorian at the Center for Immigration Studies has laid out the actual math behind why this matters: in 2014, 63 percent of non-citizen households used some form of welfare compared to 35 percent of native households, with food assistance and Medicaid usage running more than double.

Krikorian's point isn't that immigrants are lazy, it's that admitting people with little education produces predictable welfare dependency, and pretending otherwise is how you get a broken system.

Rubio knows the 75-country list is going to get relitigated for months, so he's building a vetting process the courts can't strike down with one nationality-discrimination ruling, because it applies to everybody, everywhere, the same way.

That's not Orwellian.

That's called doing your job after a judge tries to take the keys away.
