Texas Judge Struck Down a Biden Gun Rule the Supreme Court Upheld Once but This Time is Different

The Supreme Court upheld Biden's ghost gun crackdown by a lopsided seven to two vote last year.

Chief Judge Reed O'Connor just declared that same regulation unconstitutional anyway.

The reason both rulings cannot coexist says everything about how shaky Biden's gun grab always was.

Judge Reed O'Connor Sides With Defense Distributed Against the ATF

Judge O'Connor is not some random name on a docket.

He is the Chief United States District Judge for the Northern District of Texas.

He was appointed by George W. Bush.

He sided with Defense Distributed and the Second Amendment Foundation, which joined the case as co-plaintiffs against the ATF.

Defense Distributed built its name selling downloadable gun files and a machine called the Ghost Gunner, which lets a private citizen mill their own firearm at home.

Founder Cody Wilson has been fighting Washington over homemade firearms since before most people had ever heard the phrase ghost gun.

O'Connor did not mince words.

"The Final Rule does not merely lack supporting analogues," he wrote.

"It contradicts the actual historical tradition of personal gunsmithing," he continued.

"Self-manufacture of firearms in America was common and indeed foundational to establishing our Nation," he added.

Then he granted a permanent injunction blocking the ATF's frame or receiver rule, the regulation better known as the ghost gun rule, outright.

That rule redefined unfinished metal and polymer blanks as regulated firearms.

It meant background checks, serial numbers, and federal licensing requirements that never existed before Biden's ATF invented them.

O'Connor ruled the whole thing void for vagueness under the Fifth Amendment, on top of the outright Second Amendment violation.

That is a federal judge telling regulators they built a trap door and called it law.

Why This Ruling Cuts Against What Nine Justices Already Decided

Here is the part that should make Washington nervous.

The Supreme Court already ruled on this exact regulatory scheme.

In Bondi v. VanDerStok, the justices upheld the ATF's ghost gun rule by a seven to two margin last year.

Gun control groups celebrated.

Now a sitting federal judge has looked at how that same rule actually gets enforced and found it does not survive contact with the Constitution.

Second Amendment Foundation Senior Director of Litigation William Sack said the ruling exposed how the ATF had been operating on a "we know it when we see it" standard instead of an actual legal one.

Defense Distributed did not win by rehashing arguments the Supreme Court already rejected.

It won by proving the rule collapses once you look at how the ATF applies it against real people building real firearms.

That distinction is exactly why this fight is not over.

The Department of Justice can still appeal to the Fifth Circuit, a court with little patience for federal agencies inventing new gun restrictions out of thin air.

This Is Not the Last Ghost Gun Fight Washington Will Lose

Americans watched the ATF try to regulate homemade guns out of existence, and this is exactly the kind of ruling that terrifies the gun grabbers.

Biden’s ATF built a rule so broad it could send a hobbyist to federal prison for owning a block of plastic.

O'Connor just handed every defense attorney in the country a roadmap for tearing that rule apart in court.

The ATF pretended this fight ended the moment VanDerStok came down.

It did not.

It just moved to a new battlefield, and Defense Distributed just won the first battle on it.

Watch the Fifth Circuit next, because that is where this fight heads, and it is not a friendly courtroom for federal gun regulators.
