Bragg agrees with Trump request to delate immunity ruling
Democrat activist and Joe Biden donor Judge Juan Merchan agreed with Donald Trump and Alvin Bragg to postpone for one week his hearing on Trump’s motion to vacate the bogus conviction in the falsification of business records show trial that Bragg staged for Trump as part of an election interference scheme.
Judge Merchan set sentencing for November 26.
It was expected that Bragg would seek jail time and Judge Merchan would agree to locking Trump up in New York’s notorious Riker’s Island.
But Donald Trump winning the Presidential Election on November 5 changed all that.
Bragg’s prosecutors submitted a motion to Judge Merchan to push the immunity ruling to November 19 so the Manhattan District Attorney’s office could decide on how to proceed in light of Trump’s status as President-elect.
“The People agree that these are unprecedented circumstances and that the arguments raised by defense counsel in correspondence to the People on Friday require careful consideration to ensure that any further steps in this proceeding appropriately balance the competing interests of (1) a jury verdict of guilt following trial that has the presumption of regularity; and (2) the Office of the President,” the filing from Bragg prosecutor Matthew Colangelo – who previously worked as a top official in the Biden Justice Department – read.
“Accordingly, the People respectfully request that the Court adjourn the upcoming scheduled dates to afford the People time to assess these recent developments, and set November 19. 2024 as a deadline for the People to advise the Court regarding our view of appropriate steps,” the filing continued.
The immunity ruling should end this case
The Supreme Court’s ruling on Presidential immunity greatly affected this case.
Writing for the majority, Chief Justice John Roberts ruled that prosecutors couldn’t introduce official acts as evidence against former Presidents in criminal prosecutions.
This presented a mortal threat to Bragg’s case as prosecutors told the jury that testimony from White House aides like Hope Hicks – including conversations that took place in the Oval Office – were damning and devastating pieces of evidence against Trump.
If Merchan had any sense this case would have been thrown out long ago.
But Merchan is a Trump-Democrat and let Bragg get this far on a blatantly farcical case that was 100% political in nature.
Trump winning the election gives Merchan yet another offramp to make this blight on the American legal system go away for good.
But will Merchan take the opportunity to avoid a Constitutional crisis where a prison sentence sits over the head of the President of the United States for the next four years?
