The provision directed the National Highway Traffic Safety Administration to mandate "advanced impaired driving prevention technology" in every new passenger vehicle sold in America.
No breathalyzer.
No police officer.

Just software – continuously watching you through interior cameras, infrared sensors, and AI systems monitoring your eye movement, head position, and driving behavior.
If the car's algorithm decides you're impaired, it can prevent or limit operation.

Freedom Caucus Votes to Defund the Car Kill Switch Mandate
On Wednesday, Rep. Cloud joined with Rep. Celeste Maloy (R-UT) and even one Democrat – Rep. Marie Glusenkamp Perez (D-WA) – to offer an amendment to the FY27 Transportation appropriations bill cutting off all funding for the kill switch mandate.
The committee passed it 33 to 26.
Freedom Caucus Chairman Andy Harris – himself a member of the Appropriations Committee – told Breitbart News exactly what every American driver is thinking: "The federal government controlling your car in the name of safety is straight-up dystopian. Americans want freedom – not Big Brother riding shotgun."
Rep. Andrew Clyde (R-GA) was equally direct: "The government should never have the authority to take control of Americans' cars. Kill Switch technology is a dystopian nightmare that we must forcefully reject and defeat at every turn."
These men are fighting for your right to drive to the grocery store without an algorithm's permission.
This Is Bigger Than Drunk Driving
Biden's team knew what they were doing when they packaged this as a safety measure.
Who opposes stopping drunk drivers?
That framing was the con.
The real architecture – cameras, AI, behavioral monitoring, passive surveillance of every trip you take – goes far beyond detecting a .08 blood alcohol level.
Your car stops being transportation the moment it becomes a sensor platform reporting on everything you do behind the wheel.
The same federal government that spent years spying on American citizens through FISA warrants, that weaponized the IRS against conservatives, that monitored parents at school board meetings as domestic terrorists – that government wants a live feed from inside your car.
Rep. Scott Perry (R-PA) introduced the No Kill Switches in Cars Act in February 2025 to repeal the mandate outright.
It remains stalled in committee.
Wednesday's defunding vote is the most concrete blow struck against this mandate yet – but the fight isn't over.
The amendment still must survive the full House, then the Senate, then conference.
Democrats and their MADD allies will fight to restore the funding every step of the way.
The question isn't whether Biden's kill switch was sold as a safety measure.
