Joe Biden isn’t leaving office quietly.

Slinking out the door in shame isn’t Biden’s plan.

And Joe Biden has one sinister plan to sabotage Donald Trump’s inauguration.

Joe Biden hampers the Trump transition

Joe Biden is pulling every trick in the book to hamstring Donald Trump’s ability to enact his agenda.

Biden recently banned offshore drilling.

Trump called Biden out for these attempts to impair Trump’s ability to set about accomplishing the business the American people elected him to carry out.

“Biden is doing everything possible to make the TRANSITION as difficult [as] possible, from Lawfare such as has never been seen before, to costly and ridiculous Executive Orders on the Green New Scam and other money wasting Hoaxes,” Trump wrote on Truth Social.

But Biden’s final attempt to trip up Trump as Trump attempts to fire out of the starting gate may be the most despicable.

Jack Smith ended his witch hunts against Donald Trump and resigned as special counsel.

That doesn’t mean Trump is free and clear.

Smith turned in a report on the classified documents and January 6 hoaxes to Attorney General Merrick Garland.

It’s up to Garland to make this report public.

Trump’s lawyers wrote to Garland filing their “demand that Smith terminate all efforts toward the preparation and release of this report.”

Attorneys representing Trump argued that Smith’s report is just one more chance to slime Trump with the political attacks Smith disguised as criminal charges.

Trump’s request

“It is clear, as has been the case with so many of the other actions of Smith and his staff, that the Draft Report merely continues Smith’s politically-motivated attack, and that his continued preparation of the Report and efforts to release it would be both imprudent and unlawful,” Trump’s lawyers added.

Trump’s attorneys also told Garland that Judge Aileen Cannon threw out the classified documents hoax on the grounds that Garland violated a clause in the Constitution in naming Smith special counsel.

Since Smith’s appointment was unconstitutional, Smith lacked the authority to file a final report.

“First, Smith lacks authority under our Constitution to issue a report because he was not validly appointed, and the plain terms of the permanent indefinite appropriation that he has pillaged for more than$20 million clearly do not apply to his politically-motivated work,” the letter added.

“The preparation and release of a report, therefore, would extend and perpetuate Smith’s violations of the Appointments Clause and the Appropriations Clause,” the lawyers stated.

Smith’s report is also a one-sided kangaroo court document that violates Trump’s guaranteed presumption of innocence since it repeats false and debunked claims about Trump inciting an insurrection on January 6.

“Second, the Draft Report violates fundamental norms regarding the presumption of innocence, including with respect to third parties unnecessarily impugned by Smith’s false claims,” Trump’s lawyers wrote.

“Releasing the report to the public without significant redactions (that would render its release meaningless) would violate prohibitions on extrajudicial statements by prosecutors and Rule 6(e),” the letter went on.

Trump’s lawyers told Garland any decision on releasing this report should be made by the incoming Trump administration.

Smith and Garland want this report out now.

The start of any administration is a honeymoon period where the President racks up wins by issuing executive orders to demonstrate he’s fulfilling the mandate handed to him by voters and watching the Senate confirm his cabinet nominees.

Smith and Garland want to provide the media anti-Trump catnip by dumping this report into the public view just as Trump takes office so the media can focus on the January 6 insurrection hoax as opposed to Trump hitting the ground running.
