This is an issue where Republicans have a major advantage.

And the Supreme Court will have Democrats in tears after Greg Abbott won this big case.

New York State Supreme Court clears way for Texas to bus illegal aliens to New York City

Texas Governor Greg Abbott started the national conversation on the border in 2022 when he began busing illegal aliens to blue cities like New York and Chicago.

Before this move, Democrats figured they could dump millions of illegal aliens in red states like Texas and their voters would never have to suffer the consequences of open borders.

That all changed when Texas began sending President Joe Biden’s illegal aliens to places like New York – where the media is headquartered – suddenly the human suffering illegal immigration inflicts on America became a national story.

New York Mayor Eric Adams (D) warned illegal immigration would “destroy” the city.

Illegal aliens now live in luxury hotels as more than 100,000 of them ended up in New York thanks to Biden’s refusal to seal the border.

New York City sued Texas to stop the Abbott administration from shipping the illegal aliens that Joe Biden smuggled into Texas to Manhattan.

The city cited a law claiming anyone who brings an individual to New York City who they know will end up on welfare must either financially support them or remove them from the city.

“The Commissioner for the New York City Department of Social Services had asked the court to enforce against eight companies Section 149 of the New York Social Services Law, which states that anyone who knowingly brings an out-of-state “needy person” into New York for the purpose of making them a public charge should be obligated to bring them out of New York or monetarily support them,” Law360 reports.

But Texas won in court.

Governor Abbott celebrated the victory.

“Another WIN! The New York Supreme Court REJECTED Mayor Adams’ attempt to block Texas from busing migrants to his sanctuary city. Until the Biden-Harris Administration secures the border, Texas will continue to send migrants to sanctuary cities,” Abbott posted on X.

Why the New York State Supreme Court sided with Abbott

Justice Mary V. Rosado disagreed.

Rosado wrote that the right to interstate travel is guaranteed under the Constitution.

And that if New York enforced rules that prevented Texas from shipping illegal aliens to New York, the country would end up with 50 different sets of rules about who could enter each state and under what conditions.

“The mass migration of people within the country, which the commissioner seeks to chill or prevent, is an issue reserved by the Constitution for Congress, lest the United States fall to a regime of Balkanization with each state setting forth a patchwork of inconsistent criteria for crossing state lines,” Judge Rosado wrote in the order.
