Jack Smith demands Supreme Court reject Donald Trump’s claim of Presidential immunity
Special Counsel Jack Smith and his gang of Trump-hating prosecutors filed a brief with the Supreme Court demanding the justices reject former President Donald Trump’s claim of immunity from criminal prosecution due to Presidential immunity.
Trump’s appeal to the Supreme Court paused the January 6 show trial Smith planned to stage this spring to secure a predetermined guilty verdict that he and President Joe Biden believe will keep Trump out of the White House.
And what worries Smith now is the Supreme Court deciding Presidential immunity from criminal prosecution is a real thing and kicking the issue back to the lower court to determine if Trump’s conduct meets whatever standard the court sets.
That would make it impossible for him to ever get this case to trial before the election.
That’s why he filed a brief asking the court to reject the idea of Presidential immunity wholesale.
“The President’s constitutional duty to take care that the laws be faithfully executed does not entail a general right to violate them,” Smith’s filing read.
“The effective functioning of the Presidency does not require that a former President be immune from accountability for these alleged violations of federal criminal law,” Smith added. “To the contrary, a bedrock principle of our constitutional order is that no person is above the law — including the President.”
Smith’s demand sets up the possibility of Barack Obama facing criminal charges
But there is a massive downside to Smith’s argument.
If Trump wins the election, he could very well use Smith’s precedent against Democrats.
In 2011, former President Barack Obama ordered the drone bombings in Yemen that killed American citizen Anwar al-Awlaki and his 16-year-old son Abdulrahman Anwar al-Awlaki, also an American citizen.
Smith claiming there is no such thing as Presidential immunity is an engraved invitation for Trump’s Department of Justice to investigate, indict, and prosecute Obama on murder charges for the killing of al-Awlaki and his son.
One of the hallmarks of the Trump years is Democrats and the media adopt hushed tones as they claim he is destroying constitutional norms and threatening American democracy when in reality it’s Democrats who are the ones actually committing these offenses.
Democrats are the ones actually using the justice system to try and jail their political opponents and they are so blinded by the idea that they think a criminal conviction is the only way to defeat Trump that no one is stopping to think about the repercussions of this course of action.
