Judge protects MS-13 gang member from deportation
A federal magistrate judge in Tennessee agreed to delay the release of MS-13 gang member Kilmar Abrego Garcia so he doesn’t get re-deported.
The shocking decision came after Garcia’s attorneys argued that President Donald Trump’s administration might actually follow through on its promise to re-deport the alleged dangerous criminals.
According to the AP, Garcia’s lawyers asked the judge to delay his release because of what they described as “contradictory statements” by the Trump administration over what would happen to the Salvadoran national.
The lawyers wrote in a brief to the court that “we cannot put any faith in any representation made on this issue” by the Justice Department.
They added that the “irony of this request is not lost on anyone.”
The irony is that defense attorneys are literally asking a judge to keep their client in jail longer to prevent him from being sent back to his home country.
This is the upside-down world we’re living in where keeping a dangerous gang member in American custody is somehow considered protecting his rights.
Obama appointee ordered gang member’s release
The case began when US District Judge Waverly Crenshaw, an Obama appointee, said Garcia should not be detained as he awaits trial on federal human smuggling charges.
Judge Crenshaw is the second judge to order Garcia released pending trial.
Last Sunday, federal magistrate judge Barbara Holmes ruled that Kilmar Abrego Garcia should not be detained on his criminal charges.
Garcia was not released from prison because he was detained by ICE.
The Department of Justice last Thursday told a judge that they will begin deportation proceedings after a federal judge ordered Garcia to be released.
The DOJ previously told the Court that Garcia will be deported to a “third country” that is not El Salvador after he is released from a Tennessee jail.
Government prosecutors did not give a timeline for the removal process but said it was not imminent.
Garcia faces serious human trafficking charges
Earlier this month, Kilmar Abrego Garcia pleaded not guilty to human smuggling charges and fought for his release pending trial.
Garcia appeared in a Nashville court clad in a red jumpsuit.
A federal grand jury in Tennessee recently indicted Garcia for “transporting undocumented migrants within the United States.”
He was charged with one count of conspiracy to transport aliens and one count of unlawful transportation of undocumented aliens.
According to the indictment, Garcia and co-conspirators from El Salvador, Guatemala, Mexico and the US were smuggling illegal aliens from 2016 through 2025.
“If convicted at trial, the defendant faces a maximum punishment of 10 years’ imprisonment for ‘each alien’ he transported,” the government said.
That means Garcia could face decades in prison if convicted on all counts.
Gang member linked to murder and violence
The charges against Garcia paint a picture of a dangerous criminal who has been operating for years.
According to government court filings, a Garcia co-conspirator told federal officials that Garcia was involved in the murder of a rival gang member’s mother.
Last month Fox News obtained 2022 bodycam footage that shows Garcia being caught human smuggling in Tennessee.
The footage reveals the complete failure of the Biden administration to deal with dangerous criminals.
Biden’s FBI was called and said to simply release Garcia.
Biden’s ICE was called and never bothered to show up.
For years, the Biden administration allowed MS-13 gang members like Garcia to operate with impunity across the country.
Trump crackdown has judges scrambling
The Trump administration has made it clear that MS-13 and other transnational gangs will be treated as the Foreign Terrorist Organizations they are.
President Trump designated MS-13, along with several drug cartels, as Foreign Terrorist Organizations in his first weeks back in office.
This gives law enforcement unprecedented tools to go after these violent criminals and their networks.
But liberal judges appointed by Democrat presidents are doing everything they can to obstruct Trump’s efforts to make America safe again.
The fact that defense attorneys are asking judges to keep their clients in jail longer rather than risk deportation shows how seriously they’re taking Trump’s promises.
These attorneys know that under Trump, being deported actually means being deported – not released with a promise to show up for a court date years in the future.
