Joe Biden addressed the nation on Thursday night, where he finally admitted that his true goal was disarming all Americans.

Biden issued a call for Congress to ban so-called “assault weapons.”

But Fox News legal contributor, Greg Jarrett, pointed out that such a law would violate the Constitution.

“As is often the case with Biden, he has sought to vilify the incorrect target. His obstacle to the gun control measures he envisions is that pesky document called the Constitution and, specifically, the Second Amendment. As a lawyer, he should know this but apparently does not. Someone should clue him in. If he does know, then he’s guilty of recklessness for the sake of demagoguery,” Jarrett wrote.

Jarrett explained that in the 2008 District of Columbia v. Heller case, the Supreme Court struck down gun bans for commonly owned firearms.

“In the seminal case of District of Columbia v. Heller, the U.S. Supreme Court validated an individual’s right to keep and bear arms under the Second Amendment. Biden is correct when he states that this cherished right is not absolute. But he is wrong when he asserts that Congress has the power to outlaw the guns he wants to ban. Neither the President nor the legislature has the authority to eliminate a constitutional right. That can only be accomplished by amending the Constitution,” Jarrett wrote.

Americans currently own between 15 and 20 million AR-15s, which is by definition a “commonly owned” firearm.

Biden also proposed a stealth gun ban by eliminating so-called “high capacity” magazines that hold more than 10 bullets.

Jarrett noted this would render millions of handguns useless, as they are built to handle magazines that hold more than 10 bullets.

If you cannot load your magazine into your firearm, the firearm is useless and is effectively banned.

This – Jarrett argued – would also run afoul of Heller.

“The President also wants to outlaw high capacity magazines. That would render the vast majority of firearms in the country inoperable since most modern guns are designed to accept only magazines that carry more than 10 rounds. Biden obviously knows this, which is the unstated intent behind his agenda that he is conveniently concealing,” Jarrett wrote.
