That’s because the Court is the one institution in America the left does not control.
But now Joe Biden got smacked with this piece of devastating Supreme Court news.
Last fall, after Donald Trump nominated Amy Coney Barrett to fill Ruth Bader Ginsburg’s Supreme Court seat, Democrats like Chuck Schumer and Alexandria Ocasio-Cortez threatened to pack the Court in retaliation if the Party won unified control of government in the 2020 election.
After the Supreme Court allowed a Texas law that effectively banned abortion after six weeks to take effect Ocasio-Cortez and her allies once again raised the prospect of packing the Supreme Court.
That did not sit well with liberal Supreme Court Justice Stephen Breyer.
In an interview with National Public Radio, Breyer warned that majorities in Washington, D.C. were not permanent and that if Democrats packed the Court, Republicans would respond in kind the next time they held power.
“What goes around comes around,” Breyer told NPR. “And if the Democrats can do it, then the Republicans can do it.”
Breyer warned that court packing could lead to a never-ending cycle of each party adding justices to the bench when they controlled the majority in the Senate and the White House.
“If A can do it, B can do it. And what are you going to have when you have A and B doing it?” Breyer wondered. “Nobody really knows, but there’s a risk, and how big a risk do you want to take?”
Court packing is wildly unpopular.
Polls show the vast majority of Americans oppose this scheme as evidenced by the fact that even conventional liberals like Breyer oppose the practice.
And that massive public opposition to court packing is why the scheme doesn’t appear to be getting off the ground.
