Leftists raged that the Supreme Court was illegitimate and attacking American democracy by siding against the Democrat Party’s political agenda in cases involving guns and abortion.

But there was no claim the Court lacked legitimacy when a five Justice majority – Brett Kavanaugh and John Roberts joined the Left – issued a ruling upholding the ability of Joe Biden to end Donald Trump’s successful “Remain in Mexico” policy.

This decision will allow Joe Biden to fully open the borders.

The Supreme Court has rejected a major challenge to President Joe Biden’s effort to shut down his predecessor’s “Remain in Mexico” program that forced many asylum seekers trying to cross the U.S. border to return to Mexico to await hearings before U.S. immigration judges.

In a 5-4 decision, the justices ruled that federal immigration law does not mandate that the Biden administration send asylum applicants back to Mexico. The decision also leaves intact, for now, the federal government’s authority to release or “parole” foreign citizens into the U.S. as they await immigration court hearings.

Chief Justice John Roberts wrote that the case hinged on how the majority viewed the Immigration and Nationality Act.

“The INA itself does not require the Secretary to continue exercising his discretionary authority under these circumstances,” Roberts wrote.

The Court’s conservatives – in an opinion written by Justice Samuel Alito – argued that the INA required the Secretary of Homeland Security to detain or expel foreigners from the country as soon as they are caught.

“DHS does not have the capacity to detain all inadmissible aliens encountered at the border, and no one suggests that DHS must do the impossible,” Alito argued. “But rather than avail itself of Congress’s clear statutory alternative to return inadmissible aliens to Mexico while they await proceedings in this country, DHS has concluded that it may forgo that option altogether and instead simply release into this country untold numbers of aliens who are very likely to be removed if they show up for their removal hearings. This practice violates the clear terms of the law, but the Court looks the other way.”

The Left’s silence on the Court’s legitimacy in this case just shows they do not believe in American institutions or democracy.

To leftists, American institutions and democracy only function if they get their way in every policy fight.
