Obamacare – the crown jewel of Barack Obama’s socialist agenda – survived two previous legal challenges thanks to Chief Justice John Roberts’ treachery.
However, conservatives believe the third time may be the charm.
The state of Texas sued the federal government over striking down Obamacare’s mandates to cover pre-existing conditions after the federal government repealed Obamacare’s tyrannical individual mandate as part of Donald Trump’s 2017 tax cut law.
Texas argued that the both mandates were inseparable and that by repealing the individual mandate, the government regulations on what health plans must cover could not stand on their own.
A trial court judge in Texas agreed and went one step further.
He threw out the entire law.
And the Trump administration just joined the state of Texas in arguing before the Fifth Circuit court of appeals that all of Obamacare must go.
The Trump administration is hardening its legal position toward Obamacare, arguing now the entire law is unconstitutional in a shift that promises to bring the issue to the forefront of the 2020 election campaign.
The position is a change for the Justice Department after it argued last year that large parts of the 2010 law — but not all of it — should be struck in the case Texas v. U.S., which is pending before the Fifth Circuit Court of Appeals. A trial court judge sided with Texas and voided the law in a December ruling. The Justice Department now says that the entire law, enacted under President Barack Obama, should be thrown out.
The filing assures renewed attention to President Donald Trump’s position that the Affordable Care Act, known as Obamacare, should be eliminated, including its subsidies and popular rules banning insurers from charging more to people with pre-existing conditions.
Conservatives have argued since Day One that Obamacare is unconstitutional.
John Roberts caved into liberal pressure in 2012 and let the law stand by rewriting the individual mandate to be a tax instead of a penalty, which the language of Obamacare clearly stated.
But now conservatives have one more bite at the apple.
