When Donald Trump appointed three Justices to the Supreme Court, it was for cases like this.
States and business interests sued the Biden administration over his illegal and totalitarian federal vaccine mandate for firms with more than 100 workers.
The Supreme Court struck down the mandate on a six to three vote, with Donald Trump’s nominees – Amy Coney Barrett, Neil Gorsuch, and Brett Kavanaugh – casting the deciding votes.
In the unsigned opinion, the six Justices blasted the Biden administration for attempting to impose an unprecedented power grab over American’s bodily autonomy.
“Administrative agencies are creatures of statute. They accordingly possess only the authority that Congress has provided. The Secretary has ordered 84 million Americans to either obtain a COVID–19 vaccine or undergo weekly medical testing at their own expense. This is no everyday exercise of federal power,” the Justices ruled.
The Justices held that the Biden administration tried to usurp Congress’ authority by imposing a vaccine mandate.
In the opinion, the six Justices pointed out that if Congress wanted administrative agencies to impose a federal vaccine mandate, it would have drafted legislative language doing so.
“We are told by the States and the employers that OSHA’s mandate will force them to incur billions of dollars in unrecoverable compliance costs and will cause hundreds of thousands of employees to leave their jobs,” the opinion read, adding that “for its part, the Federal Government says that the mandate will save over 6,500 lives and prevent hundreds of thousands of hospitalizations. It is not our role to weigh such tradeoffs.”
For 84 million Americans, this ruling was a welcome relief.
Because they possessed natural immunity or because it was their choice, many workers who did not want to take the vaccine feared losing their jobs over Joe Biden’s mandate.
Thankfully, bodily autonomy and medical freedom won out at the Supreme Court.
