The Deep State's surveillance operation against Republicans just got exposed in the ugliest way possible.
Biden's FBI didn't just target Donald Trump – they spied on Republican senators while pretending to investigate election security.
Now the judge who authorized the whole scheme is paying the price for his role in what Senator Ted Cruz called "worse than Watergate."
Texas Republican moves to hold judge accountable for Arctic Frost scandal
U.S. Representative Brandon Gill (R-TX) formally introduced articles of impeachment against U.S. District Judge James Boasberg on Tuesday for his role authorizing secret surveillance of Republican lawmakers.¹
The impeachment resolution charges Boasberg with one count of abuse of power for signing off on subpoenas and gag orders in former special counsel Jack Smith's "Arctic Frost" investigation.²
"Chief Judge Boasberg has compromised the impartiality of the judiciary and created a constitutional crisis," Gill told Fox News Digital. "He is shamelessly weaponizing his power against his political opponents, including Republican members of Congress who are faithfully serving the American people within their jurisdiction."³
The Arctic Frost investigation was opened by Biden's FBI in April 2022 – just days after Trump announced his 2024 comeback bid.⁴
Smith's team used the probe to justify sweeping surveillance of Trump's campaign apparatus and Republican allies across the country.
Gill's resolution accuses Boasberg of granting Smith "authorization to issue frivolous nondisclosure orders" covering Members of Congress "acting in accord with their legislative duties and privileges guaranteed by Article 1, Section 6, Clause 1 of the U.S. Constitution."⁵
That's the Speech and Debate Clause – the constitutional protection that prevents the executive branch from intimidating legislators with law enforcement.
Boasberg signed secret orders in 2023 preventing cell carriers from notifying Republican senators that Jack Smith's team was subpoenaing their phone records.⁶
The subpoenas targeted at least eight Republican senators and one House member, demanding "detailed records for inbound and outbound calls, text messages, direct connect, and voicemail messages" from January 4-7, 2021.⁷
FBI surveillance operation targeted 92 conservative organizations
The scope of Arctic Frost went far beyond phone records for a handful of senators.
Senate Judiciary Committee Chairman Chuck Grassley (R-IA) released documents showing the Biden DOJ issued 197 subpoenas targeting 430 Republican individuals and organizations.⁸
The enemies list included Charlie Kirk's Turning Point USA, Republican donors, conservative media outlets like Fox News and Newsmax, and Trump campaign officials.⁹
"Arctic Frost was the vehicle by which partisan FBI agents and DOJ prosecutors could improperly investigate the entire Republican political apparatus," Grassley said at a press conference last week. "Contrary to what Smith has said publicly, this was clearly a fishing expedition."¹⁰
Senator Ron Johnson (R-WI) called it "nothing short of a Biden administration enemies list."¹¹
The surveillance operation reveals how weaponized federal law enforcement became under Biden.
FBI agents used taxpayer dollars to conduct dozens of interviews across the country while tracking communications between Republican senators, White House officials, and conservative media companies.¹²
Boasberg justified his year-long gag order on phone carriers by claiming disclosure could "result in destruction of or tampering with evidence, intimidation of potential witnesses and serious jeopardy to the investigation."¹³
But that excuse falls apart when you realize the FBI was surveilling sitting United States senators who weren't even under investigation.
AT&T pushed back on the subpoenas and refused to turn over records, recognizing they violated the Speech and Debate Clause.¹⁴
Verizon rolled over and complied – meaning some Republican senators still don't know whether their phone data ended up in Jack Smith's files.
Republicans demand accountability for judicial misconduct
Senator Ted Cruz (R-TX), whose phone records were subpoenaed, immediately called for Boasberg's impeachment.¹⁵
"Judge Boasberg signed off on secret subpoenas for cell phone records of at least 9 Senate Republicans, including me," Cruz wrote on X. "IMPEACH JUDGE BOASBERG."¹⁶
Senator Lindsey Graham (R-SC) called Boasberg's authorization "legal slander" and demanded a "Watergate-style investigation."¹⁷
"My carrier, Verizon, was extremely irresponsible by complying with this subpoena," Graham said. "Instead, they should have followed AT&T's example and declined to turn over the records because it is a violation of the speech and debate clause of the U.S. Constitution."¹⁸
FBI Director Kash Patel wasted no time responding to the revelations.
Patel fired the special agent who oversaw Arctic Frost and dismantled the entire CR-15 squad that ran the partisan investigation.¹⁹
"They tracked the communications of GOP Senators," Patel wrote on X. "They weaponized law enforcement against the American people. That era is over."²⁰
Gill's impeachment resolution has 11 Republican co-sponsors backing his effort to hold Boasberg accountable.²¹
This isn't the first time Gill has moved to impeach Boasberg – he previously introduced articles in April after the judge temporarily blocked Trump's deportation flights to El Salvador.²²
House Republican leaders convinced Gill to back off that attempt, suggesting it wasn't the right tactical move.
But the Arctic Frost revelations changed everything.
When a federal judge authorizes secret surveillance of one-fifth of Republican senators to help a partisan special counsel build cases against his political enemies, that's not just bad judgment.
That's an abuse of power that demands impeachment.
The resolution now heads to the House Judiciary Committee, which will vote on whether to send it to the full House for consideration.
If the Republican majority approves impeachment, Boasberg would face trial in the Senate with Chief Justice John Roberts presiding.
Democrats claimed Trump posed a threat to democracy while they were actually using the FBI to spy on Republican senators and conservative organizations.
The hypocrisy is breathtaking.
Boasberg's role in Arctic Frost exposes how activist judges became willing partners in Biden's weaponization of federal law enforcement against political opponents.
Now he's facing consequences that could end his career on the federal bench.
